MUTUAL RELEASE AND SETTLEMENT AGREEMENT
This Mutual Release and Settlement Agreement (the “Agreement”) is made and entered
into by and between, on one hand, Khary Penebaker, Mary Arnold, and Bonnie Joseph
(collectively “Plaintiffs”), and, on the other hand, Andrew Hitt (“Hitt”), Robert F. Spindell, Jr.
(“Spindell”), Bill Feehan (“Feehan”), Kelly Ruh (“Ruh”), Carol Brunner (“Brunner”), Edward
Scott Grabins (“Grabins”), Kathy Kiernan (“Kiernan”), Darryl Carlson (“Carlson”), Pam Travis
(“Travis”), and Mary Buestrin (“Buestrin”) (Hitt, Spindell, Feehan, Ruh, Brunner, Grabins,
Kiernan, Carlson, Travis, and Buestrin are collectively “Elector Defendants”). Plaintiffs and
Elector Defendants shall be collectively referred to as the “Parties” and each, individually, as a
“Party” to this Agreement.Background. Elector Defendants, as nominated and/or replacement presidential electors for the Republican Party in Wisconsin in 2020, met and voted for Donald J. Trump and Michael R. Pence on December 14, 2020, because they were told that it was necessary to
preserve their electoral votes in the event a court challenge may later change the outcome of the
election in Wisconsin, and in compliance with requests initiated from the Trump campaign and
the Republican Party of Wisconsin. The Plaintiffs allege that in doing so the Elector Defendants
violated state and federal law and, furthermore, that the Plaintiffs, as well as other voters,
taxpayers, and Democratic electors, have been harmed by such actions. The Elector Defendants
dispute those allegations (the “Dispute”). The Plaintiffs commenced a lawsuit against the Elector
Defendants and others alleging and asserting various claims related to the Dispute in Dane
County Case No. 22-CV-1178 (“Lawsuit”), which is also the subject of an appeal and cross-
appeals, Appeal No. 23-AP-1985 (“Appeal”). The Parties participated in settlement discussions
in November 2023 and reached an understanding as set forth in this Agreement. The Parties wish
to forgo the time and expense of litigating these matters and wish to settle any and all claims the
Parties may have against each other. The Parties, in consideration of the mutual promises set
forth in this Agreement and for other good and valuable consideration, which is acknowledged,
agree to the terms herein and to comply with the same.

Elector Defendants’ Agreement Related to Certain Activities. In
consideration and fulfillment of the promises exchanged, the Elector Defendants agree to the
following:
a. The Elector Defendants agree not to serve as presidential electors in 2024 or in
any United States presidential election in which Donald J. Trump is on the ballot.
b. The Elector Defendants agree to refrain from participating in any way in the
execution or transmission of electoral votes in 2024 or in any United States
presidential election in which Donald J. Trump is on the ballot.
c. Regardless of whether Donald J. Trump is on the ballot, the Elector Defendants
agree that with respect to all future United States presidential elections they will
not participate in the execution or transmission of any document that purports to
be a certificate of electoral votes of the duly elected presidential electors for the
State of Wisconsin if, at the time of the execution or transmission, the persons
voting have not been certified as the persons elected as presidential electors under
Wisconsin law.
d. The Elector Defendants agree to fully cooperate, or continue to cooperate, with
any ongoing or future investigation or prosecution by the United States

Public Statement, Disclosure of Discovery Responses and Disclosure of
Certain Documents Produced.
a. The Elector Defendants will provide a public statement, set forth below, regarding
the Dispute and will provide a copy of such statement to the President of the United States
Senate, the Wisconsin Secretary of State, the Archivist of the United States, and the Chief Judge
of the United States District Court for the Western District of Wisconsin. The public statement
shall read as follows:
On December 14, 2020, in compliance with requests received from the Trump campaign
and the Republican Party of Wisconsin, we met at the Wisconsin State Capitol and
executed a document titled “Certificate of the Votes of the 2020 Electors from
Wisconsin.” That document stated, in part, that we were “the duly elected and qualified
Electors for President and Vice President of the United States of America from the State
of Wisconsin.” The Elector Defendants took the foregoing action because they were told
that it was necessary to preserve their electoral votes in the event a court challenge may
later change the outcome of the election in Wisconsin. That document was then used as
part of an attempt to improperly overturn the 2020 presidential election results.
The duly elected presidential electors for the State of Wisconsin for the 2020 presidential
election were: Meg Andrietsch, Shelia Stubbs, Ronald Martin, Mandela Barnes, Khary
Penebaker, Mary Arnold, Patty Schachtner, Shannon Holsey, Tony Evers, and Benjamin
Wikler.
We hereby reaffirm that Joseph R. Biden, Jr. won the 2020 presidential election and that
we were not the duly elected presidential electors for the State of Wisconsin for the 2020
presidential election.

We oppose any attempt to undermine the public’s faith in the ultimate results of the 2020
presidential election.
We hereby withdraw the documents we executed on December 14, 2020, and request that

they be disregarded by the public and all entities to which they were submitted

Nevada GOP ‘fake electors’ indicted for falsely claiming Trump won state’s 2020 election

A Nevada grand jury on Wednesday charged six Republicans who claimed to be presidential electors in 2020 and submitted certificates to Congress falsely asserting that former president Donald Trump had won the election in their state.

Nevada Attorney General Aaron D. Ford (D) launched an investigation earlier this fall, making his the third state after Georgia and Michigan to seek charges against the pro-Trump activists who met and cast ballots for the then-president on Dec. 14, 2020, despite Joe Biden’s victory.

“When the efforts to undermine faith in our democracy began after the 2020 election, I made it clear that I would do everything in my power to defend the institutions of our nation and our state,” Ford said in a statement Wednesday. “We cannot allow attacks on democracy to go unchallenged. Today’s indictments are the product of a long and thorough investigation, and as we pursue this prosecution, I am confident that our judicial system will see justice done.”
