The state earlier this week seized control of the park without authorization from the city under an emergency declaration signed by the governor, putting up fencing and blocking entry points with military vehicles. Federal agents have also been blocked from accessing a key staging area just south of the park, the filing said.
“Texas’s new actions … demonstrate an escalation of the State’s measures to block Border Patrol’s ability to patrol or even to surveil the border and be in a position to respond to emergencies,” the DOJ filing said. The filing urged the high court to “restore Border Patrol’s access to the border it is charged with patrolling and the migrants it is responsible for apprehending, inspecting, and processing.”

Ohio’s law is a little bit different than other state laws, though has plenty of similarities. This one focuses more on “parental” controls and notifications, requiring social media sites to alert parents and get their consent before kids could use certain sites. Of course, parents can already kinda do that by controlling what devices their kids have and how they’re configured.
So, really, what this law is about is making sure kids aren’t able to surreptitiously use sites their parents don’t want them to. And that raises serious 1st Amendment questions. As NetChoice notes, this all seems like a classic moral panic against new media:
A federal judge blocked an Ohio state law that would prevent minors from using social networks without parental consent, calling it a “troublingly vague” law that likely violates the First Amendment. Ohio’s “Parental Notification by Social Media Operators Act” affects websites including Facebook, X (formerly Twitter), and YouTube.
“Foreclosing minors under sixteen from accessing all content on websites that the Act purports to cover, absent affirmative parental consent, is a breathtakingly blunt instrument for reducing social media’s harm to children,” US District Judge Algenon Marbley wrote in an order issued Tuesday. “The approach is an untargeted one, as parents must only give one-time approval for the creation of an account, and parents and platforms are otherwise not required to protect against any of the specific dangers that social media might pose.”
